Consumer Privacy Policy

Who this notice covers

This notice applies to personal information Ally Property Management and Real Estate handles in connection with prospective and current buyers, sellers, landlords, property owners, rental applicants, residents, tenants, vendors, and other consumers who interact with Ally.

Employment and independent-contractor records, information governed by separate legal notices, and information exempt from applicable privacy law may be handled under different requirements.

Information we may collect

Depending on the relationship and service, Ally may collect:

  • contact and identity information, such as name, address, telephone number, email, date of birth, signature, and government-issued identification;

  • property, lease, application, transaction, showing, maintenance, and communication records;

  • employment, income, rental-history, reference, credit, background-screening, and consumer-report information;

  • payment, bank, tax, trust-account, owner-disbursement, and vendor-payment information;

  • device, portal, account, security, activity, cookie, and similar tracking information generated through approved systems;

  • accommodation, accessibility, or other sensitive information provided when needed to respond to a lawful request; and

  • other information a person chooses to provide or that Ally lawfully receives from service providers, public records, transaction participants, or business partners.

Ally’s website may use cookies and similar technologies to operate the website, maintain security, and understand aggregate website traffic and usage. You may control cookies through your browser or device settings, although some website functionality may be affected. Ally does not use website traffic or cookie data for targeted advertising.
Ally limits collection to information that is reasonably needed for a disclosed business, contractual, legal, security, or operational purpose.

How we use personal information

Ally may use personal information to:

  • provide real-estate brokerage, leasing, and property-management services;

  • communicate with consumers and respond to requests;

  • process applications, verify information, and conduct lawful screening;

  • prepare, sign, administer, and retain agreements and transaction records;

  • collect and disburse funds, perform accounting, issue tax records, and prevent fraud;

  • coordinate maintenance, inspections, vendors, access, and property operations;

  • comply with legal, licensing, Fair Housing, FCRA, tax, trust-account, insurance, audit, and recordkeeping duties;

  • protect people, property, accounts, systems, and legal rights; and

  • operate, monitor, and improve Ally’s services and approved systems.

How we disclose information

Ally may disclose personal information when reasonably necessary to:

  • property-management, transaction, accounting, screening, e-signature, payment, communications, cloud, security, and technology service providers;

  • property owners, clients, transaction participants, lenders, title/escrow providers, inspectors, attorneys, accountants, insurers, vendors, and contractors when relevant to the service or transaction;

  • consumer reporting agencies and screening providers as permitted by law;

  • regulators, courts, law enforcement, government agencies, or other parties when required or permitted by law; and

  • a successor or potential successor in a merger, sale, reorganization, or similar business transaction, subject to appropriate safeguards.

Service providers are expected to use information only for authorized purposes and to protect it appropriately. These providers may include SimpleVoIP for business text messaging, AppFolio for property-management records and communications, and RentCheck for inspection records, photos, notes, scheduling, and related property-management services.

Messaging Privacy Policy

This Messaging Privacy Policy explains how Ally Property Management & Real Estate collects and uses information in connection with its text-messaging program (the “Messaging Service”). Ally uses SimpleVoIP to provide the Messaging Service. For this purpose, SimpleVoIP acts as Ally’s service provider and data processor.
Collection of Information
For the Messaging Service, Ally may collect the phone number provided, message content or messaging history, consent or opt-in records, opt-out requests, and related service communications. This information may be collected when a person submits an inquiry, requests a text message, communicates with Ally, or receives service-related communications from Ally or an authorized service provider.
Use of Information
Ally uses Messaging Service information to deliver, maintain, secure, support, document, and improve requested communications, including service-related and transactional messages such as maintenance coordination. Marketing texts require separate consent. Providing a phone number or submitting a website form does not by itself create SMS consent.
Sharing of Information
Ally may share, transfer, or disclose Messaging Service information with a person’s consent, as necessary to provide requested services, or in the following circumstances:

  • Service providers: Ally may share information with SimpleVoIP, AppFolio, RentCheck and other service providers that help Ally provide, maintain, secure, document, or support the Messaging Service and related property-management or real-estate services. RentCheck may support inspection records, photos, notes, scheduling, and related maintenance or resident-service records; it is not necessarily the sender of SMS messages. Authorized maintenance vendors and contractors may receive or send service-related communications when necessary to complete a requested maintenance matter.

  • Legal requirements and protection: Ally may disclose information when reasonably necessary to comply with applicable law or legal process, respond to government requests, enforce agreements, protect the rights, privacy, safety, or property of Ally or others, or pursue available remedies and limit damages.

Protection of Information
Ally uses reasonable physical, technical, administrative, and organizational safeguards designed to protect Messaging Service information against unauthorized access, use, alteration, disclosure, loss, or destruction. No online activity can be guaranteed to be completely secure, and Ally cannot guarantee the security of information transmitted online.
Mobile Information and Do Not Share Statement
Mobile information and text-messaging originator opt-in data and consent will not be sold, rented, or disclosed to third parties or affiliates for marketing or promotional purposes. This does not prevent disclosure to SimpleVoIP, AppFolio, or another service provider when necessary to provide requested messaging or related services, or when disclosure is required by law.
Retention of Information
Ally retains Messaging Service information for as long as a person participates in the Messaging Service or as needed to provide services, comply with legal obligations, resolve disputes, protect Ally and its customers, and enforce agreements. Records may be retained according to Ally’s applicable record-retention requirements.
Choices and Controls
Consent to receive automated text messages is not a condition of any purchase, sale, lease, or service. Message and data rates may apply. Message frequency may vary. To stop receiving text messages from Ally, reply STOP, QUIT, CANCEL, OPT-OUT, or UNSUBSCRIBE to any text message. Reply HELP for assistance. Opting out of marketing texts does not necessarily stop necessary service, account, maintenance, safety, legal-notice, or other communications related to an active relationship.

Sale, targeted advertising, and profiling

Ally does not sell personal information for money and does not knowingly sell sensitive personal information.
Ally does not use personal information for targeted advertising or profiling that produces legal or similarly significant effects unless Ally first updates this notice and provides any choices required by applicable law.

Sensitive information

Ally collects sensitive information only when reasonably needed for an authorized purpose. Sensitive information may include government identifiers, account credentials, financial information, precise geolocation, biometric or genetic information, information revealing racial or ethnic origin, health diagnoses, sexual orientation, citizenship or immigration status, or information about a known child.
Ally will obtain consent before processing sensitive information when applicable law requires consent. Information supplied for a reasonable-accommodation, accessibility, safety, or legal request will be limited to what is needed, protected from unnecessary access, and handled under applicable housing and privacy requirements.

Privacy rights

When the Nebraska Data Privacy Act or another applicable privacy law applies, an eligible consumer may have the right to:

  • confirm whether Ally processes their personal information and obtain access;

  • correct inaccurate personal information;

  • request deletion, subject to legal and operational exceptions;

  • obtain a portable copy of certain information;

  • opt out of covered sales, targeted advertising, or qualifying profiling; and

  • appeal a decision on a privacy request.

Ally will not unlawfully discriminate against a person for exercising an applicable privacy right. Ally may also choose to honor a reasonable request when not legally required, subject to identity verification, legal obligations, record-retention requirements, and the rights of others.

How to submit a request

Submit a privacy request using either method:

Include enough information to identify the requester, the relationship with Ally, and the request. Do not send Social Security numbers, bank information, identification images, or other sensitive documents through ordinary email unless Ally provides an approved secure method.
Ally may request reasonable information to verify identity and authority. An authorized agent may submit a request when permitted by law, but Ally may require proof of authorization and identity verification.

Response and appeal process

When applicable law requires a response, Ally will respond within the legally required period—generally 45 days under the Nebraska Data Privacy Act—with any permitted extension notice.
If Ally denies all or part of a request, the response will explain the reason and provide appeal instructions when required. To appeal, reply to the decision or contact Ally using the methods above and state that an appeal is requested. Ally will respond within the period required by applicable law.
Some information cannot be deleted or changed when it must be retained for a transaction, contract, legal claim, tax, trust-account, Fair Housing, FCRA, licensing, fraud-prevention, security, or other lawful purpose.

Security and retention

Ally uses reasonable administrative, technical, and physical safeguards designed to protect personal information. No system is completely secure.
Personal information is retained according to applicable law, contractual requirements, business needs, legal holds, and internal retention policies. When eligible for destruction, records are disposed of using methods appropriate to the sensitivity and format of the information.

Changes to this notice

Ally may update this notice when its practices, systems, vendors, or legal obligations change. The “Last updated” date identifies the current version. Material changes will be communicated or posted as required by applicable law.
